SMAI Terms & Conditions

Welcome to the SMAI website and service ("Site" and "Service"), operated by J Lo Enterprises (Pty) Ltd t/a Leadpro Systems LLC ("Leadpro," "we," "us," or "our"). By accessing or using the Site or Service, you ("User" or "you") agree to these Terms of Use ("Terms"). If you do not agree, do not use the Site or Service. These Terms form a binding agreement under South African law.

1. Description of Service

SMAI is an AI-powered tool that automatically generates and attempts to publish daily social media posts for businesses on GBP, Facebook, Instagram, and LinkedIn, based on your provided information. The Service uses our technology stack (Leadpro Systems CRM, Google Drive, Google Apps Scripts, Google Sheets, JSON files, Pabbly automation). We make no guarantees about post creation, publication, or results - use at your own risk.

2. Eligibility and Account

You must be 18+ and authorized to bind your business. Registration requires accurate information. You are responsible for account security and all activity. We may suspend or terminate accounts for any reason.

3. User Responsibilities

* Provide accurate, lawful onboarding data; we rely on it entirely without verification.

* Review all posts daily and edit/delete as needed; we do not monitor.

* Comply with all laws (e.g., POPIA, CPA) and platform terms.

* Maintain valid platform accounts and permissions.

* Do not misuse the Service (e.g., spam, unlawful content).

* You bear all risks of platform suspensions or failures.

4. Intellectual Property

All Site content, SMAI tech, code, workflows, and assets are owned by Leadpro or licensors. You get a limited license to use the Service during your subscription - no copying, modification, or distribution. Published posts are your responsibility, but underlying elements remain ours.

5. Data and Privacy

You consent to data processing per POPIA, including international transfers (e.g., U.S.) with equivalent protections (Section 72). You are the responsible party; we are the operator. See our Privacy Policy for details. No data exports provided; manage your backups.

6. Disclaimers

The Site and Service are "as is" without warranties. We disclaim liability for:

* API/outages, software failures, post rejections.

* Platform actions (suspensions, deletions).

* Results, accuracy, or business impacts.

* Third-party content/links.

7. Limitation of Liability

To the fullest extent allowed by law, Leadpro is not liable for any damages, losses, costs, or claims (direct, indirect, consequential) from Site/Service use. Your sole remedy is to stop using. Liability capped at one month's fees.

8. Indemnity

You indemnify Leadpro against all claims, losses, fines, and costs from your use, data, breaches, or platform issues.

9. Termination

We may terminate access anytime. Upon termination, cease use; we may delete data.

10. Dispute Resolution

Disputes governed by South African law. Negotiate first, then AFSA mediation/arbitration.

11. General

* Changes: We may update Terms; continued use = acceptance.

* Severability: Invalid terms don't affect others.

* No Waiver: Delays in enforcement aren't waivers.
